Sean Patterson and Henry Pottie appeared separately in Moncton provincial court on Wednesday.
The two men are accused of killing Upper Cape resident Jamie Leard on May 25, 2021, and are now facing a joint charge of first degree murder. This means there will be one preliminary enquiry for the case, and if it proceeds, one trial.
Patterson and Pottie are charged with the first degree murder of Jamie Leard on May 25 in Upper Cape, about halfway between Port Elgin and Cape Tormentine.
Police had originally believed Leard was last seen on May 26, but have since updated their statement, saying they now believe Leard was killed on May 25.
Police have yet to identify remains found in the course of their investigation into Leard’s disappearance, and are now waiting on results of DNA testing for a positive identification.
The date for a preliminary enquiry, which is expected to take five days, will be set in another hearing on July 12.
Patterson and Pottie last appeared in court to set a date for a preliminary enquiry on June 9, but neither man had consulted a lawyer at that point, and so the court adjourned until Wednesday so the two could seek help from legal aid. Wednesday’s adjournment will allow time for both lawyers and the court to find a date to accommodate a 5-day preliminary enquiry.
